Is it haram to charge late fees?

Yes, according to most scholars, charging a late fee that you keep for yourself is riba. Once someone owes you money, adding extra because they paid late is the classic form of interest on a debt. Many scholars allow a "charity late fee" clause instead, where the penalty goes to charity rather than to you.

Why a late fee counts as riba

When you finish a job or rent out a room, the client or tenant owes you a fixed sum. That's a debt. In pre-Islamic Arabia, lenders would say at the due date, "Pay now, or pay more later." The Quran forbade this, and scholars across the four schools agree that any increase on a debt in return for extra time is riba, whether it's called interest, a penalty or an admin fee.

وَإِن كَانَ ذُو عُسْرَةٍ فَنَظِرَةٌ إِلَىٰ مَيْسَرَةٍ ۚ وَأَن تَصَدَّقُوا۟ خَيْرٌ لَّكُمْ ۖ إِن كُنتُمْ تَعْلَمُونَ "And if someone is in hardship, then [let there be] postponement until [a time of] ease. But if you give [from your right as] charity, then it is better for you, if you only knew." Quran 2:280

The charity-penalty clause

Late payment is still wrong on the payer's side. The Prophet ﷺ said that delay in paying a debt by someone who can afford it is injustice (Sahih al-Bukhari 2400). To discourage it without riba, many contemporary scholars and Islamic finance standard-setters accept a clause where the late payer commits to pay a set amount to charity. You don't keep it, so you don't profit from the delay. Some scholars also allow you to recover actual, documented costs, like a court or collection fee, though others are stricter on this.

Freelancers and landlords

  • Freelancers: remove "1.5% per month on overdue invoices" from your terms. Use the charity clause, or simply pause work until invoices are paid.
  • Landlords: standard leases often include a late rent fee. Replace it with a charity clause where local law allows, or hold back from enforcing it.
  • If you already collected late fees: stop going forward and give what you received to charity.

Better ways to get paid on time

You have plenty of halal tools. Ask for a deposit or upfront payment, or split big projects into milestones paid as you go. Send clear reminders and invoice promptly. Most important, distinguish between someone who won't pay and someone who can't. For a person in real hardship, the Quran asks you to give them time, and forgiving part of the debt is even better. If money owed to you is still outstanding at your zakat date, see Do I pay zakat on money someone owes me? The same riba logic applies on the other side too, in Can I still use my credit card after becoming Muslim?

Key points
  • Extra money for late payment that you keep is riba for most scholars.
  • A penalty paid to charity is widely accepted as an alternative.
  • Use deposits, upfront payment and clear terms to get paid on time.
  • Give real time to people in genuine hardship.
Tip: Update your invoice or lease template once with a short charity late-payment clause. It keeps the incentive to pay on time and removes the riba problem for every future client.
