It depends, but either way a sham marriage for a visa is haram. If a real nikah took place with all its conditions, many scholars say the contract is valid even if the motive was a visa, but deceiving the authorities and your spouse is a serious sin. A "marriage" that only exists on paper, with no real nikah, is not a marriage in Islam at all.

Marriage is a solemn covenant

Islam treats marriage as one of the most serious contracts a person can make. The Quran calls it:

وَأَخَذْنَ مِنكُم مِّيثَـٰقًا غَلِيظًا "...and they have taken from you a solemn covenant." Quran 4:21

A valid nikah needs the consent of both spouses, a wali for the bride according to most scholars, a mahr, and witnesses. It is meant to build a home with love and mercy, not to move a file through an immigration office.

What scholars say about motive

  • Real nikah, visa as one reason: many people marry partly for practical reasons. If both truly intend a lasting marriage, there's nothing wrong with also wanting to live together in one country.
  • Real nikah, planned divorce after the visa: the majority hold the contract is technically valid, but agree the hidden plan is deceit and sinful. Some scholars consider it invalid.
  • Paper-only arrangement: paying someone to register a marriage with no intention of living as spouses is fraud. It has no Islamic value and is a crime in the UK, US and EU.

The Prophet ﷺ said that actions are judged by intentions (Sahih al-Bukhari 1). He also said that marriage, divorce and taking back a wife count as serious even when done in jest (Sunan Abi Dawud 2194), so you can't treat a real nikah as a game.

The legal side

Immigration officers check whether a marriage is "genuine and subsisting." Lying to them is lying on official forms, which is haram. See Is it haram to lie on government forms? A registered civil marriage also gives a wife legal protection, which is why scholars encourage it alongside the nikah. See Do I need a civil marriage as well as a nikah?

Protect yourself

Converts, especially women, are sometimes targeted by people looking for a spouse visa. Involve a trusted wali or imam, take time to know the person and their family, and be wary of pressure to marry quickly. See Do I need a wali to get married as a Muslim convert woman?

Key points
  • A paper-only marriage for a visa is fraud and not a nikah.
  • A real nikah may be valid, but hidden deceit is still a sin.
  • Marriage is a solemn covenant, not a tool.
  • Involve a wali and take your time before marrying.
Tip: Ask an imam you trust to meet a potential spouse with you before the nikah. A sincere person will welcome it; someone who only wants a visa often won't.
